KIWI FM VODAFONE NEW ZEALAND MUSIC AWARDS
PICK THE WINNERS COMPETITION
Kiwi FM will conduct this promotion substantially as described in these rules, and by participating, each participant agrees as follows:
The Promoter is Mediaworks Ltd. specifically Kiwi FM. KiwiFM is owned by RadioWorks Limited (Number 811223) registered office 3 Flower Street, Eden Terrace, Auckland 1021.

HOW TO ENTER
1. Information on how to enter the competition forms part of the conditions of entry. Entry into the promotion is deemed acceptance of its terms and conditions.
2. Entry is open to New Zealand residents. Disqualified Participants may not enter into the Promotion. “Disqualified Participants’ are: all employees of MediaWorks, the organizers of the Vodafone New Zealand Music Awards and participating sponsors, media organisations and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
‘MediaWorks’ means all companies in the MediaWorks Group including but not limited to Mediaworks NZ Limited, RadioWorks Limited and TVWorks Limited and all brands and operating companies controlled by or associated with those entities.
3. Entry is limited to one entry per person.
4. Entry is by completing the “Pick The Winners” form on-line at www.kiwifm.co.nz. All categories must be completed for the entry to be valid.
5. To enter entrants must select the acts that they think will win the selected categories in the Vodafone New Zealand Music Awards held at Vector Arena in Auckland on October 8th, 2009
6. Entries must be received by Kiwi FM by 5pm, Thursday 8th October 2009. All entries received after this date will not be accepted. Kiwi FM takes no responsibility for a technical failure which means that an entry was not received in time.
7. By entering this promotion you agree to take part in this entire promotion, any requests, decisions or directions made or given by employees of the Promoter or sponsors (including associate sponsors) must be adhered to.
8. To claim the prize the winner must attest that they had no prior knowledge of the winners of the Vodafone New Zealand Music Awards 2009.
THE PRIZE
9. The prize consists of twenty (20) CDs by New Zealand artists as chosen by Kiwi FM and a Kiwi FM t-shirt.
SPECIFIC RULES
10. Submission of the entry is final and submitted entries may not be amended for any reason. Kiwi FM accepts no responsibility for technical failure which causes an entry to be incorrectly submitted.
11. The winner will be entrant who correctly picks the winners in the most VNZMA categories. Where two or more entrants correctly pick the most winners a draw will be used to decide the winner. The draw will be made by a Judge nominated by Kiwi FM staff. The Judge’s decision is final and no correspondence will be entered into.
12. Dates of Contest:
The promotion officially starts on Monday 14th September and finishes on Thursday 08 October 2009.
ELIGIBILITY AND LIMITATIONS.
13. Delivery Disclaimer.
MediaWorks disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item/prizes relating to the promotion that are sent by mail, courier, express, electronic transmission, or other delivery method.
14. Publicity.
By participating, all participants and winner(s) grant MediaWorks exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.
15. Release.
By participating, each participant and winner waives any and all claims of liability against the all sponsor(s) and associate sponsor(s) and promoters MediaWorks, its employees and agents, for any personal injury or loss and/or damage to property and/or self which may occur from the conduct of, or participation in, the contest, or from the use of any prize.
16. Taxes.
Any valuation of the prize(s) stated above is based on available information provided to MediaWorks. Each winner is solely responsible for reporting and paying any and all applicable taxes. Prizes are not transferable or redeemable for cash. Any prize that incurs extra costs not specified by any sponsor(s) and associate sponsor(s) will be the responsibility of the chosen winner.
17. Decisions.
MediaWorks reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the contest, or obtained winner status using fraudulent means. Further, MediaWorks will resolve any disputes; conflicting claims or ambiguities concerning the rules and decisions concerning such disputes shall be final. All decisions will be made by MediaWorks and are final. MediaWorks may waive any of these rules in its sole discretion.
18. Miscellaneous.
No purchase is necessary to participate or win. Odds of winning depend upon the number of participants.
MediaWorks may substitute prizes of equivalent value, amend the rules or discontinue the contest at any time as announced on Kiwi FM.
Mediaworks disclaims any responsibility to notify participants of any aspect related to the conduct or any variation to the terms or conditions of this promotion. Written copies of these rules (which may be updated from time to time during the promotion) are available during normal business hours at the business offices of Kiwi FM, on the Kiwi FM website and by mail upon written request with a stamped, self-addressed return envelope. All entries become the property of MediaWorks and will not be returned.
STANDARD MEDIAWORKS COMPETITION TERMS AND CONDITIONS
1. These Promotion or Competition Rules (‘the Rules’) apply to all MediaWorks Promotions or Competitions (collectively ‘the Promotion’) conducted on or off air and by means of any medium – radio, television, print, telephone or computer. The Rules may change from time to time.
2. If a particular Promotion has specific rules or terms those specific rules or terms will apply if there is any inconsistency with the Rules.
3. Unless otherwise stated in the abovementioned specific rules or terms, registration or entry is limited to 1 per couple.
4. Entry into the Promotion is deemed to be acceptance of the Rules and confirmation that the entrant has the necessary authority (for example from the bill payer or owner of a telephone) to enter the Promotion.
5. The Promotion is open to New Zealand Residents only. Disqualified Participants may not enter in the Promotion.
6. MediaWorks reserves the right to exclude any person from participating in the Promotion on reasonable grounds.
7. MediaWorks reserves the right to refuse to award any prize to an entrant who MediaWorks decides (in its sole discretion) has violated the Rules, gained unfair advantage in participating in the promotion or won using fraudulent means.
8. By participating, entrants grant MediaWorks exclusive permission to use their names, characters, photographs, voices and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use.
9. All entrant personal details will be held by MediaWorks and may be used for the purpose of the Promotion and for future promotion and marketing purposes in accordance with MediaWorks Privacy Policy (see
www.mediaworks.co.nz) unless otherwise directed by entrants at the time of entry.
10. When submitting entry via text, the telephone number from which the entry was made will be stored in a database. The participant has a two-business-day period from the time of entry to request removal from the database. If no request is made it is deemed acceptance that the information can be used at the discretion of MediaWorks and/or any other company associated with the promotion.
11. Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification – active, through to and beyond the date of the Promotion’s completion.
12. Where the Promotion involves texting, the following apply:
a) Any form of automated text message is invalid
b) MediaWorks takes no responsibility for text costs incurred after the Promotion has closed as stipulated in the
Promotion Terms and Conditions.
Winning the Prize
13. Only the person who originally entered the Promotion can be awarded the prize (‘the Winner’).
14. The Winner will be determined by Judging Panel.
15. The Judge’s determination of the Winner will be final and no correspondence will be entered into.
16. The Winner will be notified by email, phone (voice or text) or mail and must be available for the preparation of all publicity that may be required by MediaWorks. Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another winner. If, after successful notification, the prize is not collected within two months of being announced it will be regarded as forfeit. (Note: 3 attempts to contact will include individual calls to any numbers provided at the time of entry. However, should the prize’s total worth equal less than NZD$250 and be a live-to-air draw, only one failed attempt at contact will be acceptable before the Judge selects another winner.)
17. The prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf. In the event that the prize specified in the Promotion becomes unavailable for any reason the Promoter may substitute a prize of like or equal value. Where the prize incorporates air travel, unless otherwise specified the air travel is economy class.
18. Where the Winner is required to claim the prize in person and they must provide proper identification (eg driver’s licence, passport, birth certificate). If the Winner is under the age of 18 years their parent or guardian must give their prior written consent to the award of the prize.
19. The Winner takes the prize entirely at his/her own risk and indemnifies MediaWorks in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or other costs that may be associated with the prize.
MediaWorks Responsibility
20. MediaWorks reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason.
21. MediaWorks takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Acts of God or otherwise.
22. To the fullest extent permitted by law MediaWorks will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the Promotion prize.
Acceptance
23. Participation in the promotion is deemed acceptance of these Terms and Conditions.
